Milky Mama LLC ("Milky Mama," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have. It applies to milky-mama.com and related pages, emails, and services (the "Services").

By using the Services you acknowledge this Policy. If you do not agree, please do not use the Services.

1. Information We Collect

Information you give us directly

  • Contact and account details: name, email, phone, shipping/billing address.
  • Order details: products purchased, order history, subscription selections.
  • Payment information: processed by our payment providers (Shopify Payments, Shop Pay, Shop Pay Installments, PayPal, Affirm, and Afterpay). We do not store full card numbers.
  • Optional profile data you provide (e.g., baby's age, feeding stage) used to personalize product recommendations and email content.
  • Communications: messages you send to support, reviews, survey responses, sweepstakes/giveaway entries.

Information collected automatically

  • Device and usage data: IP address, browser type, device identifiers, pages viewed, referring URLs, and interactions, collected via cookies and similar technologies (see Section 5).
  • Session-replay and analytics data (e.g., Microsoft Clarity) that records on-page interactions such as clicks and scrolling. This tool is configured to mask sensitive text and input fields.

Information from third parties

  • Advertising and analytics partners (Meta, Google, and TikTok) may share campaign and audience data.
  • Fraud-prevention and shipping partners.

2. How We Use Your Information

  • Process, fulfill, and ship orders and manage subscriptions.
  • Provide customer support and respond to inquiries.
  • Send transactional messages (order confirmations, shipping updates).
  • Send marketing emails/SMS with your consent where required; you can opt out anytime (see Section 6).
  • Personalize product recommendations and content (including using baby's age).
  • Measure and improve site performance, merchandising, and marketing.
  • Detect, prevent, and address fraud, abuse, and security issues.
  • Comply with legal obligations and enforce our terms.

We do not sell your personal information for money. Some sharing for targeted advertising may qualify as a "sale" or "sharing" under certain U.S. state laws — see Section 7 for how to opt out.

3. How We Share Information

We share personal information with:

  • Service providers / processors who act on our behalf: e-commerce platform (Shopify), email/SMS (Klaviyo), reviews (Judge.me), analytics and attribution (Triple Whale, Microsoft Clarity, Aimerce), subscriptions (Loop Subscriptions), shipping carriers, and payment processors.
  • Advertising & analytics partners for measurement and targeted advertising (e.g., Meta, Google, TikTok), subject to your opt-out choices.
  • Legal / safety: to comply with law, respond to lawful requests, or protect rights, safety, and property.
  • Business transfers: in connection with a merger, acquisition, or sale of assets.

4. Your Choices

  • Email marketing: unsubscribe via the link in any marketing email.
  • SMS marketing: we send marketing text messages via Klaviyo with your consent; reply STOP to opt out or HELP for help. Message and data rates may apply.
  • Account info: contact us to update or correct your information.
  • Cookies: manage via our cookie banner and your browser settings (Section 5).

5. Cookies & Tracking Technologies

We use cookies, pixels, SDKs, and similar technologies for essential site function, preferences, analytics, and advertising. We use Shopify's native consent management/cookie banner to capture and honor consent where required (EEA, UK, and applicable U.S. states). This banner is enabled and scoped to those regions.

You can control cookies through the banner and your browser. Blocking some cookies may affect site functionality. We honor Global Privacy Control (GPC) signals as an opt-out of sale/sharing where required by applicable law.

6. Marketing Communications

Where required, we obtain consent before sending marketing messages, and you may withdraw consent at any time. Transactional messages (e.g., order/shipping) are not marketing and may still be sent.

7. U.S. State Privacy Rights

Depending on your state of residence (including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and others), you may have the right to:

  • Know/access the personal information we process about you.
  • Correct inaccurate personal information.
  • Delete personal information.
  • Obtain a portable copy.
  • Opt out of "sale"/"sharing" and targeted advertising.
  • Not be discriminated against for exercising these rights.

California (CCPA/CPRA): We describe categories of information collected, used, and disclosed above. We do not sell personal information for money but may "share" it for cross-context behavioral advertising. To opt out, use our Your Privacy Choices page, which includes the "Do Not Sell or Share My Personal Information" control, or contact us using the details below.

How to exercise rights: email customerservice@milky-mama.com or call 877-886-4559. We will verify your identity before responding. You may use an authorized agent. We respond within the timeframes required by applicable law.

8. EU/EEA & UK Rights (GDPR / UK GDPR)

If you are in the EEA or UK, you have rights to access, rectify, erase, restrict, or object to processing, to data portability, and to withdraw consent. Our legal bases include performance of a contract (order fulfillment), consent (marketing, non-essential cookies), and legitimate interests (site security, improvement).

You also have the right of withdrawal for certain online purchases — see our EU Right of Withdrawal page. Note statutory exemptions apply to perishable goods and sealed goods unsealed after delivery for health/hygiene reasons.

You may lodge a complaint with your local supervisory authority.

9. Data Retention

We keep personal information only as long as needed for the purposes described, including order records, tax/accounting, and legal compliance, then delete or anonymize it. We generally retain order and transaction records for 7 years to meet tax and accounting obligations, after which we delete or anonymize them.

10. Security

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information. No method of transmission or storage is 100% secure.

11. Children's Privacy

The Services are intended for adults. We do not knowingly collect personal information from children under 16. If you believe a child provided us information, contact us and we will delete it.

12. International Data Transfers

We may process and store information in the United States and other countries. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses) for cross-border transfers.

13. Third-Party Links

Our Services may link to third-party sites we do not control. Their privacy practices are governed by their own policies.

14. Changes to This Policy

We may update this Policy from time to time. Material changes will be posted here with a new "Last updated" date.
